2. Purpose and Scope
These GTC define the rights and obligations of BAO and its customers in connection with the online sale of products offered in the store.
They are accessible at any time on the website.
BAO reserves the right to modify these GTC. The GTC applicable to an order are those in force at the time the order is placed.
3. Products
BAO offers accessories and equipment for dogs and their owners for walks, travel, and outdoor activities.
The essential characteristics of the products are presented on their respective product pages.
Customers are invited to review this information before placing an order and, where necessary, to check dimensions and size guides.
The photographs and representations of the products aim to present the items as faithfully as possible. Slight differences in color or rendering may appear depending on the screens used.
4. Prices
The applicable prices are those displayed on the website at the time of the order.
They are indicated in euros (€) and include all taxes when VAT is applicable.
When BAO benefits from the VAT exemption regime, the corresponding legal notice is applied in accordance with current regulations.
Any delivery costs are indicated to the customer before the final validation of their order.
BAO reserves the right to modify its prices at any time, without retroactive effect on already validated orders.
5. Order
The customer selects the products they wish to purchase and adds them to their cart.
Before final validation of their order, they can check their cart, selected products, quantities, and total price, and correct any errors.
The customer must provide accurate and complete information necessary for processing and delivering their order.
Validation of the order implies the obligation to pay.
An order confirmation is sent to the customer at the email address provided during their purchase.
BAO reserves the right to refuse or cancel an order in cases permitted by regulation, particularly in the event of suspected fraud, payment incident, or prior dispute relating to the payment of an order.
6. Payment
The available payment methods are those displayed at the time of order on the BAO store.
Payment is made through the payment providers offered on the store.
The order is not considered definitively validated until payment is confirmed.
BAO does not directly hold the customer's complete banking data.
7. Delivery
Products are delivered to the address provided by the customer when placing their order.
The customer is responsible for the accuracy of the information provided and must check their address before validating their order.
The applicable delivery terms, zones, and times are detailed on our Delivery & Shipping page and are communicated to the customer before the conclusion of the order when required by regulation.
Some products from the same order may be shipped separately. The customer may therefore receive multiple packages for a single order.
BAO remains the customer's point of contact regarding the execution of their order, even when preparation or shipping is handled by a logistics partner or supplier.
In case of delay, non-receipt, or difficulty concerning delivery, the customer is invited to contact BAO so that the situation can be examined in accordance with applicable regulations.
8. Right of Withdrawal
In accordance with the Consumer Code, the consumer generally has a period of 14 days from receipt of the goods to exercise their right of withdrawal, without having to justify their decision.
When several goods part of the same order are delivered separately, the period runs from the receipt of the last good when the corresponding legal conditions are met.
To exercise their right of withdrawal, the customer must inform BAO of their decision by means of a clear and unambiguous statement or use the standard withdrawal form at the end of these GTC.
The customer then has the applicable legal period to return the product.
Unless BAO agrees to cover these costs or when regulations provide otherwise, direct return costs are the responsibility of the customer, of which they are informed before the sale is concluded.
Practical arrangements are detailed on the Returns & Refunds page.
9. Refund after Withdrawal
In the event of a validly exercised withdrawal, BAO refunds the sums due in accordance with applicable regulations, including initial delivery costs within the limits provided by law.
The refund is made using the same payment method as that used for the initial transaction, unless the consumer expressly agrees to another method that does not incur costs.
BAO may defer the refund until the product is recovered or until the customer provides proof of its shipment, under the conditions provided by law.
The consumer's liability may be engaged in the event of depreciation of the product resulting from handling other than that necessary to establish its nature, characteristics, and proper functioning.
10. Exceptions to the Right of Withdrawal
The right of withdrawal cannot be exercised in situations provided for by regulation.
This may particularly concern certain products manufactured according to the consumer's specifications or clearly personalized, as well as certain goods which, for reasons of hygiene or health protection, have been unsealed after delivery when the legal conditions are met.
When a product offered by BAO is covered by an exception to the right of withdrawal, this information is communicated to the customer before the order.
11. Legal Guarantees
Products sold by BAO benefit from applicable legal guarantees, including the legal guarantee of conformity and, under the conditions provided by law, the guarantee against hidden defects.
These guarantees apply independently of any commercial guarantee.
In the event of a product having a defect or non-conformity, the customer is invited to contact BAO, indicating their order number and providing information to allow their request to be examined.
The exercise of legal guarantees is carried out in accordance with the provisions of the Consumer Code and the Civil Code applicable at the time of sale.
12. Liability
BAO is responsible for the proper execution of its obligations to the consumer under the conditions provided by applicable regulations.
The customer must use the products in accordance with their intended purpose and any instructions or precautions provided.
It is notably their responsibility to regularly check the condition of the equipment used with their animal and to cease its use when it shows signs of wear or deterioration likely to compromise its safety.
No provision of these GTC shall have the effect of excluding or limiting the rights necessarily held by the consumer under applicable legislation.
